Janssen denied early defeat of FCA HIV drug lawsuit

By Dave Simpson (December 21, 2021, 10:52 p.m. EST) – A New Jersey federal judge rejected an offer from drugmaker Janssen Products LP to beat a 9-year False Claims Act lawsuit, ruling Tuesday that ‘There were still many open questions in the lawsuit as to whether Janssen benefited from the off-label marketing of two drugs that can ward off HIV.

U.S. District Judge Zahid N. Quraishi rejected offer for summary judgment from Janssen, keeping alive the December 2012 lawsuit filed by two officials on behalf of the government and 27 states under FCA and federal law anti-recoil, as well as acts of false allegations in various states, concerning two drugs, Prezista and Intelence.
